Josh Blackman - an active conservative blogger - thinks Sonia Sotomayor has got it wrong when she denounced the reasoning of the court in Whole Women's Health, saying "the Imperial Judiciary should be disarmed".
Sotomayor compared today's conservatives to the notorious 19th century apologist of the slave power John C. Calhoun who enunciated the concept of state nullification of national laws. Blackman's perspective is rather that by being in the process of reversing Roe v. Wade and other concepts such as privacy holdings not rooted in literal constitutional commands the "Imperial Judiciary" is being dismantled. - GWC
