In re Humphrey: California Supreme Court hears challenge to cash bail

California Proposition 25 would have abolished cash bail and put release in the hands of judges. It was defeated in November.   

In 2018 an  appellate court in San Francisco held in In re Humphrey that bail can be set in an amount the detainee cannot afford only if there is clear and convincing evidence that no other measure will assure the defendant's appearance at trial. Humphreys - then 63 was accused of stealing $7 and a bottle of cologne.  Bail was set at $600,000, later reduced to $350,000.
The case was argued today before the California Supreme Court.
