Retainer Study Panel Should Consider the 'Nuclear Option' | New Jersey Law Journal

An ad hoc committee appointed by the New Jersey Supreme Court will soon be empaneled to suggest how to approach the problems of the inherent conflicts of interest between lawyer and client in "fee shifting" cases. In such matters (e.g. discrimination and legal malpractice cases under New Jersey law) hourly rates are often an inadequate guide to what is a reasonable fee. In Balducci v. Cige the high court voided a fee agreement and remanded for a `quantum meruit' evaluation by the trial judge. = gwc
