Sometimes you have to love the New York courts. When 51 y.o. Calvin Thomas was visiting his mother on East 143rd Street in the Bronx he fell and severely injured his ankle. Surgery, pins, arthritis, walk with a cane, can't walk long distances (try the subways and stairs in the City).
Contrary to the myth of the Bronx jury he got $70,00 with no award for future pain and suffering. To the rescue: the Appellate Division of the Supreme Court increases the award against the City Housing Authority to...$375,000.
No way in hell would a New Jersey judge grant an additur motion like that. The Court of Appeals is a graveyard for plaintiffs. I hope they don't bother with the case.
